What is ONYX Driver Pay?

ONYX Driver Pay lets transport companies keep or raise driver net pay while reducing employer-side employment costs. Most classic employer cost items are removed or restructured so you optimise transport spend without cutting driver wages.

What does the law say?

The Driver Pay model is designed for compliance with employment, pay, and benefits rules across the markets we support. Experts continuously align the model as regulations evolve—this summary is informational, not legal advice.

Who registers the driver in IMI?

The licensed carrier must register the driver in IMI when posting rules apply—regardless of B2B vs other contract forms—if the driver performs cabotage or cross-trade in another EU state. What matters is who is the carrier on CMR/transport documents, not only the contract label.

Can social authorities force an employment contract?

As an independent contractor, the driver can refuse a trip without employment-style sanctions; the truck can be reassigned and a new trip offered later. That flexibility and lack of a mandatory shift pattern supports independent service provision rather than subordination typical of employment.

Who records working time?

The carrier still records driver time under road transport rules, even if the driver is an independent contractor. The licensed carrier organises transport and remains responsible for legal compliance.

Does the driver need their own transport licence?

If the driver serves a carrier who holds the licence and appears as carrier on documents, a separate licence is usually not required. EU Regulation 1072/2009 targets undertakings organising road transport, not drivers working under a carrier’s licence. A licence is needed when the driver independently organises transport as carrier on documents.

Should ONYX be a temporary-work agency?

Under interpretations from the Polish labour inspectorate (PIP), ONYX Driver Pay does not need temporary-work-agency status.

Is paid annual leave included?

Independent contractors do not receive paid annual leave like employees; higher day rates are designed to offset income gaps during breaks.

What if a driver is ill or cannot work?

Income-protection insurance is available. After waiting periods (e.g. 21 days illness / 14 days accident), benefits may apply for total temporary disability—up to a defined share of monthly income for up to 24 months, with extensions possible for permanent disability, subject to policy terms.
